SimplyProperty, Inc. — Premium Membership Terms and Conditions

These Terms and Conditions (“Terms”) govern the Premium Membership (“Membership”) offered by SimplyProperty, Inc. (“we,” “our,” or “us”) to clients (“you” or “member”). By purchasing a Membership, you agree to these Terms.

1. Membership Term and Payment

The Premium Membership is a twelve (12)-month commitment, billed annually in advance.
The full Membership fee is non-refundable once payment is processed.
The Membership automatically renews each year unless you provide written notice at least thirty (30) days before renewal that you do not wish to renew.
All fees are subject to applicable taxes.
All Membership benefits take effect from the date the Membership is activated and payment is received.

2. Membership Benefits

a. Priority Booking
Members receive first-priority scheduling for all service requests, allowing them to skip the queue and be scheduled ahead of non-members. This benefit applies except where other Premium Members already have confirmed bookings. Priority Booking does not guarantee same-day or specific appointment times and is subject to weather, safety, and workload conditions.

b. No Emergency Fees
Members are exempt from the standard emergency or urgent call-out fee for requests requiring same-day or expedited service. Regular labour, materials, and standard service rates still apply.

c. 5% Off All Services
Members receive a 5% discount on all services performed by SimplyProperty, Inc. while their Membership is active.
The discount applies only to services scheduled and completed after the Membership is activated and payment has been received.

d. 30-Day Clog-Free Guarantee (Gutter Cleaning)
For gutter cleaning performed for Premium Members, we guarantee that the cleaned gutters will remain free-flowing for thirty (30) days after service.
If a clog occurs within this period due to normal debris, we will return once at no charge to clear the affected area.

This guarantee applies only to properties that:

Do not have coniferous (needle-bearing) trees overhanging or adjacent to the roofline, and
Have properly installed gutter strainers at all downspouts.
If these conditions are not met, the guarantee does not apply.

3. Cancellation and Non-Refundability

The Membership is annual and non-cancelable during the active term.
You may choose not to renew for the following year by giving written notice at least 30 days before renewal.
No partial, prorated, or early-termination refunds are issued.
Your statutory rights under applicable consumer-protection laws remain unaffected.

4. Modifications and Additional Benefits

We may, at our discretion, introduce new or enhanced Membership benefits during any active term.
Any added benefits will automatically apply to current members at no additional cost.
Reductions or removals of benefits, or changes in pricing, will take effect only upon renewal, with reasonable notice provided before your next billing cycle.

5. Limitation of Liability

To the fullest extent permitted by law, SimplyProperty, Inc.’s total liability under this Membership shall not exceed the Membership fee paid for the current annual term.

6. Governing Law

These Terms and Conditions are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein.
Any disputes shall be brought exclusively before the courts of British Columbia.

By purchasing the Premium Membership, you acknowledge that you have read, understood, and agree to these Terms and Conditions, including the twelve-month commitment, annual billing, and non-refundable payment policy.
